The Clean Society - Terms of Services

IMPORTANT: These Terms affect your legal rights and obligations. Please read them carefully before booking or using services from The Clean Society. Nothing in these Terms is intended to limit any rights or remedies that cannot lawfully be waived under applicable Ontario or Canadian law.
Section 1 – Introduction & Acceptance of Terms
Welcome to the Terms of Service of The Clean Society (“The Clean Society,” “we,” “us,” or “our”), a cleaning service based in Mississauga, Ontario and serving residential and commercial clients throughout Mississauga, Brampton, Toronto and the Greater Toronto Area (“GTA”).
These Terms govern the relationship between The Clean Society and the customer booking or receiving our cleaning services (“you” or “your”). By booking, purchasing, authorizing, or using our services, you acknowledge that you have read and agree to these Terms, subject to applicable law.
Section 2 – Quotes & Initial Consultation
Please contact us to request a quote for your proposed cleaning service. Unless expressly stated otherwise, quotes are estimates based on the information provided at the time of booking, including the size, condition and requested scope of the property.
If the actual condition or scope materially differs from what was described, additional time or charges may be required. Where practicable, we will advise you of a material price increase and obtain your authorization before performing work beyond the agreed scope.
Quotes are generally valid for thirty (30) days unless otherwise stated.
Section 3 – Performance of Services
The Clean Society will perform the cleaning services identified in your booking confirmation, quote, invoice or other written agreement. You are responsible for reviewing the scope and advising us before service if anything material is missing.
Services may be performed by employees, contractors or other authorized service providers engaged by The Clean Society. Your agreement is with The Clean Society, not with an individual cleaner.
Arrival and completion times are estimates. Traffic, weather, prior appointments, emergencies and other circumstances may cause delays or rescheduling. We will make reasonable efforts to communicate material delays.
We may assign or change the cleaner or cleaning team servicing your property. Requests for a particular cleaner will be considered but cannot be guaranteed.
You must provide safe and timely access to the property. If we cannot access the property at the scheduled time, cancellation, lockout or rescheduling charges may apply as disclosed at booking.
If you are not present at completion, the service will be considered completed when our team leaves the property, subject to the Satisfaction Guarantee below.
The presence of movers, tradespeople, contractors or other unaffiliated workers may affect our ability to complete or guarantee portions of the cleaning. We are not responsible for conditions created after or during our work by third parties.
- Wall washing, grout restoration, re-caulking, interior dishwasher cleaning, exterior windows and other exterior cleaning are not included unless expressly quoted.
- Specialty, restoration, hazardous-material, pest-remediation or other non-standard work is excluded unless expressly agreed in writing.
- All services are subject to applicable safety requirements and law.
Section 4 – Pricing & Service Options
We may offer flat-fee, hourly and recurring cleaning services. The applicable price, inclusions and any minimum booking requirements will be communicated in your quote or booking confirmation.
For hourly services, our team will clean as much as reasonably possible within the time purchased. Completion of every requested task is not guaranteed. Additional time may be purchased, subject to availability, at the applicable rate quoted or communicated at the time.
Recurring services may be offered weekly, bi-weekly, monthly or at another agreed frequency. Pricing may vary based on property condition, frequency, scope and other factors.
Where recurring services are set to renew automatically, you authorize the applicable recurring charges until the service is cancelled in accordance with these Terms. We will provide notice of material pricing changes where required by law or our agreement.
Section 5 – Deposits
We may require a deposit to reserve a service date or secure a booking. The amount and any applicable refund or credit conditions will be disclosed before payment.
A booking requiring a deposit is not confirmed until the deposit is received. Unless otherwise stated or required by law, the deposit will be applied toward the total service price.
Section 6 – Payment & Billing
All prices are stated in Canadian dollars (CAD) unless expressly indicated otherwise. Applicable taxes will be added where required.
We may accept credit card, debit card, electronic transfer or other payment methods communicated at booking. By providing payment information, you represent that you are authorized to use that payment method and authorize applicable charges for services you purchase.
Invoices are due according to the payment terms stated on the invoice, quote or booking confirmation. Where no different payment term is stated, payment is due within forty-eight (48) hours of receipt.
Overdue balances may accrue interest or reasonable collection costs only to the extent disclosed and permitted by applicable law. We may suspend future services while an account is overdue.
If you believe a charge is incorrect, please contact us promptly so that we can investigate. Nothing in these Terms prevents you from exercising lawful rights available through your financial institution or under applicable consumer-protection law.
Section 7 – Service Standards & Insurance
We aim to perform services professionally and in accordance with reasonable industry standards.
The Clean Society will maintain insurance appropriate to its operations as required by applicable law and its business arrangements.
Section 8 – Cancellations, Refunds & Satisfaction Guarantee
Cancellation and rescheduling requirements, including any applicable fee, credit or deposit treatment, will be communicated at booking. Unless otherwise stated, we ask that cancellations or changes be made at least twenty-four (24) hours before the scheduled start time.
Late cancellations, lockouts or cancellations after a team has travelled to or arrived at the property may be subject to the applicable cancellation or trip fee disclosed at booking.
Refund eligibility will depend on the circumstances, the work performed, these Terms and applicable law. Nothing in these Terms limits a refund or remedy that must be provided under applicable law.
If you are dissatisfied with the quality of a completed cleaning, notify us in writing within forty-eight (48) hours and identify the areas of concern. Where reasonably appropriate, we will be given an opportunity to inspect and re-clean the affected areas. This re-cleaning commitment is our Satisfaction Guarantee and is subject to reasonable access to the property.
Section 9 – Workplace Health & Safety
The safety of our cleaning teams and customers is important. We may decline, stop or modify work that we reasonably believe presents a health or safety risk.
- Work requiring unsafe heights or access beyond equipment approved by The Clean Society.
- Cleaning biohazardous materials, bodily fluids or other hazardous substances unless specifically agreed and appropriately handled.
- Cleaning areas with active pest infestations, significant mold, toxic substances or unsafe structural conditions.
- Any task that would reasonably jeopardize the health or safety of our workers or others.
Known pest infestations, including bed bugs, cockroaches or fleas, must be disclosed before arrival. We may refuse or discontinue service where an undisclosed infestation or hazardous condition creates a material health, safety or contamination risk. Any fee or refund decision will be handled in accordance with the circumstances, our disclosed booking policy and applicable law.
Section 10 – Property, Pets, Valuables & Service Limitations
You are responsible for securing pets and informing us of any relevant pet-related risks. We are not responsible for harm arising from circumstances outside our reasonable control, subject to applicable law.
Please secure cash, jewelry, sensitive documents and other valuables before service. You must identify fragile, irreplaceable, specialty-finished or otherwise sensitive items and advise us of any special care requirements.
You are responsible for informing us of surfaces, fixtures, furnishings or materials that require specialty products or cannot safely be cleaned using ordinary cleaning methods. We are not responsible for pre-existing damage, ordinary wear, unstable fixtures or damage caused by undisclosed defects or sensitivities, except to the extent liability cannot lawfully be excluded.
Damage or loss should be reported to us as soon as reasonably possible with photographs or other relevant information so we can investigate.
For move-in or move-out services, access must remain available if you wish to use our Satisfaction Guarantee. We cannot guarantee that a cleaning will satisfy every landlord, property manager, purchaser or third-party inspection standard.
If the property condition is materially different from what was disclosed, we may offer additional time at the then-applicable rate or complete as much as reasonably possible within the original booked scope. We will not intentionally exceed an agreed material price increase without authorization.
Section 11 – Customer Feedback & Reviews
We welcome honest customer feedback and reviews. If you have a concern, we encourage you to contact us promptly and allow us a reasonable opportunity to investigate and, where appropriate, correct the issue under our Satisfaction Guarantee.
Nothing in these Terms prohibits a customer from making a truthful review, complaint, report or communication, or from exercising rights available under applicable law. We reserve all lawful rights regarding statements that are knowingly false, defamatory or otherwise unlawful.
Section 12 – Non-Solicitation of Cleaning Personnel
The Clean Society invests resources in recruiting, screening, training, scheduling and managing cleaning personnel. During your relationship with us, you agree not to knowingly bypass The Clean Society by directly engaging a cleaner introduced to you through The Clean Society for substantially similar private cleaning services without our written consent.
Where permitted by applicable law, a reasonable placement or conversion fee disclosed in advance may apply if you wish to directly engage such a worker. Any remedy for breach will be limited to remedies enforceable under applicable Ontario law.
Section 13 – Photographs & Marketing
We may wish to take before-and-after photographs of cleaning work for quality-control, training or promotional purposes. We will not intentionally publish photographs that identify you, your address, personal documents, people or other sensitive personal information without appropriate consent.
Where photographs are to be used publicly for marketing or social media, The Clean Society will obtain consent as appropriate. No royalty or compensation is payable for an authorized use unless otherwise agreed in writing.
Section 14 – Intellectual Property
The content of thecleansociety.ca, including The Clean Society name, logos, branding, text, graphics, photographs and other original materials, is owned by or licensed to The Clean Society and is protected by applicable Canadian and international intellectual-property laws.
You may not reproduce, distribute, sell, commercially exploit or use our protected content or branding without prior written permission, except as permitted by law.
Section 15 – Disclaimers
We strive to provide high-quality cleaning services, but results can vary depending on the age, condition, materials, staining, buildup and maintenance history of a property or item.
To the fullest extent permitted by applicable law, we do not guarantee that every stain, mark, odour, buildup or condition can be completely removed. Nothing in these Terms excludes statutory warranties, conditions, consumer rights or other protections that cannot legally be excluded.
Section 16 – Limitation of Liability
To the extent permitted by applicable law, The Clean Society will not be responsible for indirect, incidental, special or consequential losses arising from the services where such losses were not reasonably foreseeable or are otherwise lawfully excludable.
Any limitation of liability in these Terms is subject to applicable consumer-protection and other mandatory law. Nothing in these Terms excludes or limits liability where doing so would be prohibited by law, including liability arising from fraud, wilful misconduct or other liability that cannot legally be limited.
Claims should be brought within the limitation period prescribed by applicable Ontario law. These Terms do not shorten a statutory limitation period where doing so would be unenforceable.
Section 17 – Indemnification
To the extent permitted by law, each party is responsible for losses, claims or expenses arising from its own breach of these Terms, negligence, wilful misconduct or violation of applicable law. Any indemnification obligation will be interpreted and enforced only to the extent permitted under applicable Ontario and Canadian law.
Section 18 – General Provisions
Entire Agreement. These Terms, together with the applicable quote, booking confirmation, invoice and any written service-specific terms, constitute the agreement relating to the booked services.
Waiver. A failure to enforce a provision on one occasion does not waive the right to enforce it later.
Assignment. You may not transfer your contractual rights or obligations without our written consent, except where applicable law provides otherwise.
Relationship. Nothing in these Terms creates a partnership, joint venture or agency relationship between you and The Clean Society.
Governing Law. These Terms are governed by the laws of the Province of Ontario and the applicable federal laws of Canada. Subject to any mandatory consumer rights or jurisdictional requirements, disputes may be brought before the courts or other lawful dispute-resolution bodies having jurisdiction in Ontario.
Severability. If any provision is found invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.
Changes. We may update these Terms from time to time. The version applicable to a booking will be the version presented or made available in connection with that booking, subject to applicable law.
